- Do not move out of the marital residence, unless it has become unsafe. If you move out, especially if you leave the children with your soon to be ex, this could be viewed as your abandoning the marriage, the home and the children. If you and your spouse can agree that whoever is going to maintain possession of the children can remain in the marital home until further discussions can be had, simply prepare a written statement to be signed by both of you, and agree that this will be a temporary solution until further discussions can be carried out.
